Democracy, as a form of government, admits its split in at least two different moments: the democracy of the ancients and that of the modern ones. A distinctive feature of this last variant - the one identified as representative democracy - is the existence of representatives elected by popular vote. Given this, it has been generally held that voting and majority rule are "typically democratic" mechanisms. However, neither vote nor majority rule are exclusive to democratic systems, so defining the form that they must have when they operate in a democratic system constitutes one of the main problems of the theory of democracy and of this in relation with fundamental rights. This work addresses the problems invoked by these approaches starting, above all, from the work of Norberto Bobbio.
