Colombia becomes the first country in Latin America to decriminalize assisted suicide (and how it differs from euthanasia)
After a historic vote this Wednesday in the Colombian Constitutional Court, the country became the first in the region to decriminalize physician-assisted suicide (MAS) for people with serious or incurable illnesses.
The decision, approved by 6 votes in favor and 3 against, eliminates the punishments for assisted suicide contemplated in the Colombian criminal code, which contemplated sentences of between 16 and 36 months.
With this decision, the Colombian Court expands the rights of citizens to "die with dignity", enshrined in the Constitution and which in 1997 led to the decriminalization of euthanasia and its subsequent regulation in 2015.
The decision will come into force once the Court officially publishes the ruling, Lucas Correa, director of research at the Laboratory of Economic, Social and Cultural Rights DescLAB, the law firm that filed the lawsuit before the court, explained to BBC Mundo.
"It's always a good idea to fully understand the ruling, and the meaning of the ruling, so that you can act on the law," he said.
Who can ask?
DescLAB reported that the ruling would allow access to the SMA "when the person has expressed their free, informed and unequivocal consent; when the person has a bodily injury or a duly diagnosed serious and incurable disease."
In addition, the regulation establishes that the SMA will require that the patient "as a result of the condition, be subjected to physical and mental pain incompatible with their idea of dignity" and that "assistance to cause death be provided by a medical professional" .
