Since 1921 abortion is legal for certain cases in Argentina. However, it is a right that has historically been violated due to prejudices about women's autonomy, which had repercussions on –at least– their right to health. Before Autumn “F.,A.L.” of the Supreme Court of Justice of the Nation (CSJN) in 2012, the news about abortion addressed the undue obstacles in access to legal abortions, the delays for practices, the judicialization of cases and forced maternity. In recent years, in the country of Ni Una Menos, sexual and reproductive rights are being the subject of greater public debate because their violation implies violations of the rights to life, health, physical, mental and moral integrity. , to autonomy, intimacy, dignity, to be free from violence and cruel, inhuman and degrading treatment and to the equality of women, lesbians, girls and people with the capacity to gestate in our country. All these are rights recognized in the National Constitution and various international instruments with constitutional hierarchy and others that have a higher rank than the laws. What the Argentine Congress must vote on is whether to maintain a system of grounds in force that is restrictive in practice or whether it extends the right to legal, safe and free abortion up to 14 weeks of gestation. In the absence of established statistics, follow the figures of Edith Pantelides and Silvia Mario, from 2009, which indicate that between 370 and 522 thousand abortions are performed per year in the country. The figure is the result of the projection of hospital admissions due to problems derived from the abortion practice. The criminalization of abortion did not change the will of women who do not want to continue with a pregnancy, who did not give up making the decision autonomously either, despite the fact that the State continues to consider them the object of guardianship: the criminal prosecution only pushed them to secrecy. What the representatives must consider is whether the practice will be done in conditions of safety, equality and dignity, or whether they will keep it illegal. Legalizing abortion is a matter of social justice. This publication collects the experience of different organizations with the aim of taking it into account in legislative debates.
